Investment in property business in Singapore
Investing in lease option is a tempting deal but then again there are some drawbacks and pitfalls which one needs to be aware of before plunging in the ocean. One of the very tricky situation would be of the property owner has a mortgage and he is leasing the property out to you, whereas you in turn wants to rent it. This is quite common in Singapore and one needs to be very careful. First of all one needs to keep in mind that the seller is paying his dues well to the financial organization where the mortgage is held, otherwise the buyer may end up paying it and making necessary deductions from whatever he owes to the seller. But in this case, it may be causing lot of inconvenience and extra money, which is not the deal.
One may find a good buyer and then a better one and this is tempting as the initial one percent booking payment is not refundable. But the again one has to remember that the buyer may not be aware of this clause and would leave no stone unturned to get that money back. The seller needs to let his agent know that the buyer should be aware that in case he gives the 1% deposit and books the property and then a dispute comes up where both the parties cancels the deal then the money paid towards initial booking of the property is non refundable and the seller is not liable to any promise.
The seller should always have written disclosure of sales and leases. In case you are wondering, as a seller, that what you need to disclose, regarding the property and what need not be, do seek help from your agent and your attorney but do prepare a written disclosure, to be signed and agreed upon by both parties, before the deal is closed.
